Jason Oletsky has more than 20 years of trial and litigation experience. He concentrates his practice in the area of complex commercial litigation, with particular emphasis on private equity, mergers and acquisitions, bet-the-company, and shareholder litigation. Jason counts among his clients some of the largest private equity firms both in and outside the State of Florida. He regularly serves as outside general counsel, and provides class action defense, Fair and Accurate Credit Transactions Act (FACTA), contract, employment, trade secret, non-competition, corporate governance advice, and judgment collection/asset protection counsel for his clients. He also represents a number of high-profile professional athletes in business disputes. Jason has lectured extensively on advanced judgment collection techniques in the State of Florida and has been published for Proceedings Supplementary in Florida. Jason was the first litigator in Florida to be named by The Best Lawyers in America in the area of Private Funds/Private Equity law. He has been named one of South Florida's top litigators by Chambers USA, the South Florida Legal Guide, Florida Trend, the South Florida Business Journal, and other publications.
 
Representative Experience

Represented a veterinary hospital in obtaining a dismissal against putative class action claims alleging willful violations of the Fair and Accurate Credit Transactions Act (FACTA). See Torongo v. Roy, 176 F. Supp. 3d 1320 (S.D. Fla. 2016).

Represented a major airline in the defense of alleged Fair and Accurate Credit Transactions Act (FACTA) violations, concerning the failure to truncate credit card information on receipt.

Represents national organizations and small businesses in class action defense, including allegations of Fair and Accurate Credit Transactions Act (FACTA), Florida Consumer Collection Practices Act (FCCPA), Florida's Deceptive and Unfair Trade Practices Act (FDUTPA), and Telephone Consumer Protection Act (TCPA).

Represents and leads independent committee investigations, including one investigation leading to full dismissal of case and one where Jason successfully acted as mediator in resolving a multimillion dollar shareholder dispute, which enabled the company to be sold for over $60 million.

Regularly defends officers and directors in adversary proceedings and corporate litigation, alleging breach of fiduciary duty, aiding and abetting, and other corporate governance breaches.

Regularly pursues and defends multiple indemnification claims on behalf of private equity funds and portfolio companies based on allegations of fraud, and breaches of representations and warranties, including pursuing indemnification resulting in 100% recoveries under the purchase agreements.

Successfully defended numerous private equity funds and their portfolio companies in purchase price and working capital adjustments.

Regularly pursues and defends non-compete, trade secret, restrictive covenant, and employee handbook violations.
