The International Insolvency Institute has welcomed Adam Swick as a new member. Membership in the Institute is restricted to experienced insolvency practitioners or judges, regulators, and senior representatives from financial and academic institutions. The Institute plays a significant role in global insolvency policy and enjoys a reputation as a catalyst for improvement and change in the field.
Prior to becoming a full member of the Institute, Swick was a member of its NextGen Leadership program, and in June of 2023 he served as one of the program's delegates attending the United Nations Commission on International Trade Law meetings.
Swick has been involved in many cross-border cases over the years, from Tibanne Co. Ltd., Mt. Gox’s parent, to Saad Investments Company Ltd., which at the time was the largest Chapter 15 case ever filed. In his very first cross-border case, Condor Insurance Ltd., Swick obtained a favorable ruling from the Fifth Circuit that foreign representatives are not prohibited in a Chapter 15 proceeding from bringing fraudulent transfer actions under the laws of the foreign main proceeding.
