An article on international bankruptcy law penned by Adam Swick and Laura Taveras has been selected for inclusion in the ABI Journal’s "Best of ABI 2022: The Year in Business Bankruptcy." The annual collection features the best ABI articles highlighting the top trends in both business and consumer bankruptcy.

In their article, “A Modern Land for the Model Law” published last December, Swick and Taveras discuss the decision in In re Modern Land (China) Co. Ltd. which enhanced the flexibility of a court to determine a bankruptcy debtor’s “center of main interests” (COMI) under Chapter 15 of the Bankruptcy Code. In Modern Land, the debtor held its assets, management and business exclusively in China, but was incorporated in the Cayman Islands, which is where it negotiated a court-supervised restructuring scheme and was ultimately successful in filing for bankruptcy. 

Swick is on the leadership committee for the ABI International Committee, which was recently named ABI Committee of the Year for its success in promoting the international aspects of the organization and attracting new ABI members. Together with Taveras, he routinely files Chapter 15 bankruptcy cases on behalf of international clients.
