Traditional Labor Law Practice Co-Chair Amy Gaylord was featured in a Law360 article discussing subpoena battles dominating the National Labor Relations Board (NLRB). The NLRB is issuing more subpoenas under President Biden to build up the agency's cases against employers and unions accused of violating federal labor law. In addition to there being an increase in the number of subpoenas, there's been an expansion in the scope of subpoenas, said Gaylord, who previously worked as an attorney with the NLRB.

"Instead of the board asking for 10 things, now they're asking for 50 or 100 things," Gaylord said. "What they're really doing is using these investigative subpoenas to expand the scope of investigations and then try to find additional violations by going on a fishing expedition."
