In a Law360 article titled, "A Look Back At 2022's Biggest Wage and Hour Rulings," Wage and Hour Co-Chair Jeffrey Kimmel in New York revisited five major decisions that made a significant impact, including a new federal Department of Labor rule that restricts employers' practice of paying less than minimum wage to workers who earn tips.

Law360 wrote, "Jeffrey Kimmel, who represents employers as co-chair of the wage and hour practice at Akerman LLP, said compliance with the rule is a challenge. It requires monitoring employees on a minute-by-minute basis that isn't realistic in a hospitality workplace, and a rule that's onerous to comply with could stir up litigation that sucks up resources and harms the business and workers, he said."

"'The more a rule is so difficult to comply with that it results in more, very expensive lawsuits, the more chances that a business is not going to be able to stay in business or it is not going to be able to hire as many workers, ' he said."
