Akerman Tax Practice Co-Chair David Blum recently shared his thoughts with Law360 on a proposed bill aimed at changing how Illinois taxes online retail sales. The bill seeks to address the state’s complex “Leveling the Playing Field” law, which, among other things, requires online retailers based outside of the state to apply Illinois state and local sales tax to location of delivery, rather than where the retailer is located, causing the imposition of potentially hundreds of different tax rates each month.
Blum, along with fellow Akerman partners Stefi George and Lauren Ferrante, filed a suit last year on behalf of Florida-based PetMeds challenging the current law.
“It’s an undue burden on interstate commerce,” Blum told Law360. “[Illinois is] creating a higher burden for those who are out of the state than those who are in the state.”
