John Campo and Susan Balaschak co-authored a New York Law Journal article titled, “Structured Dismissals: Alive and Well After ‘Jevic’,” discussing the implications behind the U.S. Supreme Court’s ruling in Czyzewski v. Jevic Holding. Assisted by Scott Lawrence, the authors described why the decision is significant for Chapter 11 bankruptcies. In fact, it holds no bankruptcy court can order a distribution scheme that deviates from the Bankruptcy Code’s basic priority provisions without the consent of the parties negatively affected by them.
