Jonathan Robbins, Cannabis Practice Chair, commented on an amicus brief filed in the Florida Supreme Court, which calls the state’s cannabis licensing system for dispensaries as unconstitutional. Liner Source, Inc. said in an amicus brief that Florida’s law created a selected class of companies eligible to operate as medical marijuana treatment centers. It elaborated that the only entities that can meet the state statute's criteria to become a licensed medical marijuana treatment center are those that previously applied under an older version of the statute in 2015. 

Robbins told Law360 that Liner Source's amicus brief and the fact that a number of others have intervened in the case shows there are many potential applicants who are "frustrated that they have not even been able to participate in the process, much less be given the opportunity to demonstrate to the DOH that they are qualified to serve Florida's patients and in a safe and responsible manner."
