Joshua Bernstein and Phillip Spinella co-authored a New York Law Journal article titled, “Hotel Management Agreements and Enforcement of Forum Selection Clauses,” analyzing how New York has become a preferred litigation venue for disputes between hotel owners and their operators, no matter where their assets may be. In particular, Bernstein and Spinella discussed the statutory framework and relevant case law to consider when drafting hotel management agreements that intend to designate New York as litigation forum.
