Akerman partner and hospitality litigator Joshua Bernstein was quoted in a Law360 article entitled, “Hospitality Cases And Trends To Watch For The Rest Of 2018.” Among other developments in the hospitality industry, the article discussed the European Union’s General Data Protection Regulation (GDPR) and the threat of stiff penalties against global hotel companies that do not comply with the law. Bernstein discussed the regulation’s potential reach, expecting litigation involving indemnification clauses in hotel management agreements between owners and operators as it relates to the costs and damages of data breaches and other cybersecurity incidents.

Bernstein was quoted, “As the primary data breach cases get settled, you are going to see the hotel brands seek to pass on the damages and the costs they incurred in those litigations to their owners, even though the owners have no control over the system through which the data breaches occurred.”
