Law360 reported on an amicus brief, filed by Triangle Capital Inc. in Florida's Supreme Court in support of Florigrown. Akerman is set to deliver a second round of arguments on behalf of Florigrown in October in Florida Department of Health Office of Medical Marijuana Use et al. v. Florigrown LLC et al. Triangle Capital said in its filing that every license for a medical marijuana treatment center, or MMTC, that has been awarded by the Florida Department of Health has "been a grant of a special privilege" to a select few corporations, in violation of a 2016 voter-approved constitutional amendment legalizing medical marijuana. Akerman’s upcoming arguments will focus on the constitutionality of Florida’s law governing its licensing system for MMTCs.
