WorkedUp podcast creator and host Matthew Steinberg wrote an Inc.com column titled, “4 Things You Need to Know Before Asking a New Employee to Sign a Nondisclosure Agreement,” outlining critical factors employers should consider when using broad nondisclosure agreements to establish an employment relationship. Even though there are obvious benefits to them, from intrinsic deterrent value to staying out of the press, Steinberg explained these agreements might also have harmful employee morale drawbacks, could garner unwanted attention from federal agencies and might be difficult (and costly) to enforce. Also titled “Can We Talk About NDAs?”, the article further appeared in Chicago Tribune.
“… if you believe you have legitimate and thoughtful reasons for using these broad [nondisclosure] provisions, by all means, go for it. However, be prepared, financially, operationally and optically, to sue (or at least credibly threaten to sue) employees who breach,” Steinberg wrote.
