Richard Pinsky spoke to Law360 about new bills brought forth by the Florida Legislature intended to protect businesses from potentially frivolous lawsuits related to COVID-19. Senate Bill 72 and House Bill 7 are identical, both aiming to raise the bar on personal injury claims as the state recovers, but could face different receptions in their respective chambers.

“For sure, how nursing homes will be treated will be a controversy,” Pinsky said. “Retroactivity and raising the standard from negligence to gross negligence will be two more points of controversy.”
