New York Land Use and Zoning Partner Vivien Krieger recently discussed a landmark Soho residential project in The Real Deal that became the first to utilize the city’s new approach to Mandatory Inclusionary Housing (MIH) compliance. Vivien explained that the area’s housing stock “is ripe for this,” referring to the innovative use of the fee-in-lieu option to meet affordable housing requirements.

She highlighted how this route provides developers with a practical way to navigate complex rezoning and land use challenges, especially when on-site affordable units are difficult to deliver.

“While the project’s contribution to the Affordable Housing Fund is substantial,” Vivien added, “it also gives developers a clear pathway forward and demonstrates that, even in challenging neighborhoods, new housing opportunities are possible.”

Her insights reflect Akerman’s ongoing work in helping clients adapt to evolving land use and zoning regulations in New York City.
