Magnuson-Moss Warranty Act:
Represented a major producer and retailer of manufactured homes in arbitration proceeding involving various breach of warranty claims arising under the Magnuson-Moss Warranty Act. Claimant alleged that the home suffered from substantial manufacturing and installation defects, seeking an order rescinding the purchase contract and awarding compensatory damages, punitive damages, and attorneys’ fees. After a multi-day hearing, the arbitrator ruled in favor of client on all claims, awarding claimant zero dollars.
Fair Housing Act:
Represented an affordable residential apartment community before the Department of Administrative Hearings in connection with a Petition for Relief following a referral by the Florida Commission on Human Relations. The claimant alleged numerous violations of the Fair Housing Act, including various forms of harassment, housing discrimination, failure to provide reasonable accommodation, failure to provide access to facilities, discriminatory assessment of fines, and other alleged acts of discrimination on the basis of race, disability, and familial status. Following a full-day evidentiary hearing, the Department entered a Recommended Order in favor of client, finding zero liability on all claims.
Commercial Litigation:
Acted as outside legal counsel for the Jacksonville division of a global transportation and logistics firm in commercial litigation and transactional matters. Litigation work primarily involved drafting and arguing dispositive motions before courts throughout the state of Florida, while transactional representation included drafting business documents for use by client in various commercial contexts, such as pre-litigation risk management, dispute resolution, and collections.
