People

Andrew Gold has extensive experience litigating cases in and outside of Florida. He focuses on complex commercial litigation with particular emphasis on private equity, corporate governance, post-merger and acquisition disputes, misappropriation of trade secrets, and restrictive covenants. Andrew additionally handles large scale construction disputes. Andrew’s corporate client base is comprised of private equity funds and portfolio companies, manufacturers, real estate developers, software developers, database hosters, restaurants, retailers, and service providers. Andrew also acts as a neutral in mediation and arbitration proceedings.

Andrew has been repeatedly named one of South Florida's top litigators by highly regarded publications such as Best Lawyers, the South Florida Legal Guide, Florida Trend, and the South Florida Business Journal. He has lectured on complex commercial litigation issues, and has presented at the Capital Connection Conference sponsored by the Association for Corporate Growth and the Brookings Institution's Judicial Education Program in Washington, D.C.

Business Disputes:

eVestment Alliance, LLC: Represented the leading institutional investor financial database and cloud-based solutions provider at trial in a Computer Fraud and Abuse Act and theft of trade secrets claim in U.S. District Court for the Southern District of Florida, successfully obtaining judgment against the competitor, including punitive damages and the recovery of attorneys’ fees.
Specialty Construction Contractor: Represented a nationwide specialty construction contractor in U.S. District Court for the Eastern District of Virginia against a competitor and its former national sales director for misappropriation of trade secrets, breach of restrictive covenants and related claims, successfully obtaining injunctive relief.
Broker Dealer Corporate Dispute: Represented two founders of a broker-dealer against claims by a third founder that he was “squeezed out” of the company and denied fair compensation, obtaining a favorable summary judgment in U.S. District Court for the Middle District of Florida.
Musicland Holding Corp.: Represented two former directors of a large music and video retailer (annual revenues in excess of $1 billion) at trial in the U.S. Bankruptcy Court for the Southern District of New York against claims that they breached fiduciary duties and authorized an illegal dividend by allowing the company to make a substantial payment to a former shareholder, purportedly in satisfaction of an intercompany debt, obtaining favorable settlement mid-trial.
Post-Acquisition Dispute: Represented the purchaser of five dental practices in arbitration in Massachusetts, obtaining judgment for breaches of representations and warranties contained in an asset purchase agreement, including the recovery of attorneys’ fees.
Oracle Flexible Packaging: Represented the seller of an aluminum manufactured flexible packaging and metal casting business at trial in the Delaware Superior Court against claims of breach of an asset purchase agreement, obtaining a favorable judgment on all claims.
Post-Acquisition Dispute: Represented the purchaser of a storm water mitigation and environmental erosion construction company in the Chancery Court in Nashville, Tennessee, against the seller’s claims of fraudulent inducement, conspiracy to defraud, and implied partnership, obtaining dismissal of all claims at the pleading stage.
Google Fiber Network: Represented a private equity firm in arbitration in Washington, D.C., against claims arising from its portfolio company’s construction of portions of the Google Fiber network, successfully obtaining a defense judgment.

Construction Disputes:

High-Rise Building Collapse: Represented the receiver for a condominium association in construction defect litigation in Miami-Dade Circuit Court after the collapse of a high-rise building in Surfside, Florida.
Construction Defect and Delay Claims: Represented the owner/developer of a luxury high-rise condominium at trial in Broward County Circuit Court alleging construction defect and delay claims and obtained a favorable settlement mid-trial.
Large Private Home Builder: Represented one of the largest private home builders in the nation against multiple claims of construction defects resulting in mold growth, purportedly rendering homes uninhabitable.
