Akerman is pleased to share that Daniel Miktus will serve as a panelist at the Society of Construction Law North America (SCLNA) Regional Workshop, a half-day program exploring the lifecycle of construction claims and disputes, from contract formation through dispute resolution.
Daniel will participate in the session, "Preventing and Positioning Claims Before a Dispute Arises," which examines the proactive strategies owners, developers, contractors, and counsel can implement to mitigate risk and preserve claims before a dispute develops. The discussion will address key contract provisions that often influence the outcome of construction claims, including notice requirements, change order procedures, no-damage-for-delay clauses, flow-down provisions, and dispute resolution mechanisms. Panelists will also discuss the importance of contemporaneous project documentation and the early identification of issues such as differing site conditions, design deficiencies, and schedule disruptions.
The workshop's broader program follows the progression of a construction dispute, covering claim development and damages analysis, as well as strategies for resolving disputes through mediation, arbitration, and litigation.
