Akerman's Atlanta Office Managing Partner Jason Lichtstein and Partner Michael Larson will present on the MyLawCLE panel “PFAS Contamination at Brownfield Sites: Due Diligence, CERCLA Liability, and Regulatory Compliance.” The program will examine the legal and regulatory challenges associated with PFAS contamination at brownfield sites, including environmental due diligence, federal and state regulatory requirements, and potential liability following the designation of PFOA and PFOS as CERCLA hazardous substances.

The discussion will also address preserving bona fide prospective purchaser protections, managing PFAS-related exposure through contractual and insurance tools, navigating state brownfield and voluntary cleanup programs, and pursuing regulatory closure when PFAS remains on site. Attendees will gain insight into sampling, notification and reporting obligations, cleanup agreements, institutional and engineering controls, continuing obligations, and reopener and property-transfer risks.
