The joint employer issue is one of the top problems employers who use staffing agencies or contracted labor are not even aware they have. There is no bright line rule for when companies are joint employers, but when they are found to be, it subjects both companies to joint and several liability for the other company’s employment law violations. Lilly Moon will discuss the factors considered by courts and federal agencies in determining whether a joint employer relationship exists and practical steps employers who use staffing agencies or contracted labor can take to mitigate against unknowingly forming a joint employment relationship.
