Noam Fischman and Douglas Paul will speak at an Association of Corporate Counsel National Capital Region program titled “Red Flags, Red Herrings, and Real Risk: The Legal Significance of Data-Driven Allegations” on November 18.
The program will explore how data mining and advanced analytics are transforming the identification, investigation, prosecution, and defense of potential fraud and compliance violations. Noam and Douglas, joined by an in-house panelist, will discuss how data-driven allegations arise through internal employee complaints, whistleblower complaints, and government investigations, including matters involving the False Claims Act, Anti-Kickback Statute, and the federal securities laws. The panel will also examine the challenges organizations face when analytics raise questions about organizational knowledge, internal investigations, and regulatory obligations, as well as the legal significance of how organizations identify and respond to potential misconduct.
