Litigation special counsel Rola Daaboul authored an article for the Austin Business Journal, titled, "What Austin businesses need to know about NFTs." She explains the various scenarios in which NFTs may be subject to litigation, including what happens if one buys an NFT only to discover the NFT seller copied the work of another artist, how the right of publicity plays a role, and the legal risk of destroying an NFT. Daaboul notes that given the new and unique nature of NFTs, it is possible some legal resolutions may depart from previous laws, but to minimize risks, buyers and sellers alike should carefully consider their decisions.

Daaboul wrote, "The issues and others pertaining to NFTs will not be resolved in an article; they’ll have to see their day in court, and some of the resolutions may depart from previous laws, since we are talking about an idea, a product, that is new to America and the world. Just as we needed new 'rules of the road' when buggies were replaced by Buicks, courts may eye NFTs through a different lens, either because of or despite the differences with the protectable works that have come before."
