Stacy Bercun Bohm, Fort Lauderdale Office Managing Partner Leslie Miller Tomczak and Jennifer Rabin co-authored a Law360 article titled, “Make Sure to Own the Architectural Plans That You Paid For,” outlining the importance of establishing and maintaining rights in the ownership of architectural plans. Bohm, Tomczak and Rabin addressed the roots of disputes over such plans, which are copyrightable works under the Architectural Works Copyright Protection Act, due to the often collaborative and fluid design process involving numerous stakeholders and impacted by myriad external factors. The authors also offered owners tips on protecting their rights, focusing in particular on the development of clear language that sets forth ownership rights in the instruments of service with architects and subconsultants.
