With more than 28 years of experience in infrastructure and energy transactions, Eddie Lowry is a trusted authority for clients in this dynamic and rapidly evolving sector. He advises developers, operators, and investors on the full economic cycle of data centers and data energy projects, including all aspects of development, operation, energy procurement, tax incentives, construction, acquisition, disposition, finance, land use, and leasing for this niche asset class.

An integral part of the Data Centers and Digital Infrastructure Practice, Eddie has extensive experience in advising clients on data center development and operations. He advises developers, operators, and investors on data center development projects, including financing, tax incentives, land assemblage, permitting, land use, environmental, energy and infrastructure procurement strategies and agreements, leasing, colocation, hyperscale, and lease and licensing agreements. He advises on the development of sites to be used as data centers, including the sale and leaseback of data center assets. He adeptly maneuvers through the entitlement process for clients, securing necessary governmental approvals and permits related to data center development. He has significant experience in advising clients on the complexities of all aspects of data center operations, including leasing, subleasing, colocation, and related services, including experience advising on the related service level maintenance agreements and assisting with data privacy policies and various user agreements. His experience further includes energy and power agreements, water allocation, fiber and telecommunication issues, colocation agreements, master service agreements, and management-related issues. Eddie further provides advice on the acquisition of data center asset purchases and divestitures, including portfolio acquisitions and divestitures.

Eddie counsels clients in negotiations with energy companies, including Independent Power Producers (IPPs), natural gas, traditional utility grid power, solar and wind companies, and traditional fossil fuel uses. He further represents energy company clients in the context of supplying energy to large scale electron users. His experiences includes representing energy companies and lenders in connection with the acquisition, disposition, financing, tax credits, and development of energy projects, including for use by high capacity electron users such as data centers, artificial intelligence (AI) learning, and crypto mining.

As it relates to infrastructure, Eddie regularly advises and counsels clients on issues related to infrastructure projects, with substantial experience in the development of data centers, logistics, warehouse, and industrial properties. He represents clients in connection with development, tax incentives, energy procurement, energy development, acquisition, zoning, public and private finance, land development, appurtenant rights, municipal law, utility law, and construction.

In addition, Eddie has an inside track on the railroad industry where he advises clients in rail agreements, land use control, and acquisition and development of real property and real property interests related to railroad infrastructure.
