Jani Mikel focuses her practice on complex commercial litigation. Jani represents public and private companies in a wide range of matters, including data privacy, toxic torts, antitrust and trade regulation, products liability, restrictive covenant violations, employment litigation, and other commercial matters. Jani has litigated cases in both federal (including appellate courts) and state courts and has litigated matters in binding arbitration.

Jani also represents companies and individuals in regulatory, civil, and criminal proceeding initiated by government agencies for alleged wrongdoing and advises clients on enforcement and other litigation matters, including allegation of bribery, the Anti-Kickback Statute, and financial and regulatory fraud (e.g. False Claims Act).

Jani has experience conducting data breach investigations and counseling clients on incident response plans. She assists companies from notification of the data incident through engaging necessary forensic consultants, investigating the data breach, determining notification requirements, and interfacing with regulatory agencies as necessary. She also assists clients by conducting risk assessments, revising internal security policies, and regulatory compliance with federal, state, and international regulations, such as California Consumer Privacy Act (CCPA), the California Privacy Rights Act (CPRA), and the EU’s General Data Protection Regulation (GDPR).

Her experience with complex antitrust issues includes managing the collection, review, and submission of information in response to Civil Investigative Demands and Second Requests, and assisting in the case management and strategy throughout the stages of investigatory proceedings. Additionally, Jani advises clients on eDiscovery issues.
