Kathleen Prystowsky is a partner in the Litigation Practice Group whose practice centers on complex commercial disputes in the real estate and hospitality sectors. She represents hotel owners, operators, developers, private equity firms, and family offices in high-value litigation and arbitration, with particular depth in matters involving hotel management agreements, franchise agreements, ground leases, joint venture agreements, and shareholder disputes.  

Her approach integrates litigation strategy with her clients' broader business objectives, recognizing that disputes involving real estate and hospitality assets often implicate both short-term and long-term investment considerations. Whether the goal is to preserve an existing relationship, exit a troubled arrangement, or protect the value of an asset through resolution, Kathleen works closely with clients to develop strategies that advance their commercial interests while managing litigation risk.

Kathleen's hospitality litigation practice encompasses the full range of disputes arising under hotel management and franchise agreements, including terminations, performance disputes, and enforcement actions. She advises clients on the business and financial implications of their contractual positions. Her practice also extends to highly complex, fast-moving, bet-the-company disputes, including those arising from mergers and acquisitions in the hospitality industry, working closely with Akerman's corporate transactional team to provide clients with a seamless hospitality practice.

In her real estate litigation practice, Kathleen handles ground lease disputes, joint venture disputes, shareholder derivative actions, commercial landlord-tenant matters, and construction litigation. She has represented institutional and private clients in complex commercial lease enforcement actions, rent-reset disputes, investor disputes, and class action defense, among others.

Kathleen has tried cases for her clients in both state and federal courts, as well as in arbitration before the American Arbitration Association (AAA), JAMS, the International Chamber of Commerce (ICC), and the International Center for Dispute Resolution (ICDR).
