Practice Update

Executive order 202.7 Governor Cuomo signed last night permits a less stringent version of remote online notarization in New York — eliminating the industry's signer authentication step. From March 19, 2020 through April 18, 2020, any notarial act required under New York state law may be performed using audio/video technology. The signer must either be personally known to the notary or present a valid photo ID during an interactive video conference. The video conference must allow for direct interaction between the notary and signer and the signer must affirm their physical presence in New York. The signer must transmit the document to the notary, who will notarize the document and return it to the signer.
